1. Acceptance of Terms

By accessing or using the telephon.ai website and services operated by NQB AI Inc. ("we", "our", "us"), you agree to be bound by these Terms of Use. If you do not agree, please do not use our services.

2. Description of Services

telephon.ai provides AI-powered phone agent services for businesses. Our agents answer phone calls, route inquiries, take messages, and perform other telephone-based tasks on behalf of our clients. Services are provided on a subscription basis as described on our pricing page.

3. Eligibility

Our services are designed for businesses. By using telephon.ai, you represent that you are authorized to enter into agreements on behalf of your organization and that you are at least 18 years of age.

4. User Responsibilities

Provide accurate and complete information when setting up your account and configuring your AI agent.
Ensure that your use of the service complies with all applicable laws, including privacy legislation.
Inform your callers that calls may be handled by an AI agent and/or recorded, as required by applicable law.
Not use the service for unlawful, fraudulent, or harmful purposes.

5. Intellectual Property

All content, software, design, and branding on the telephon.ai website and platform are the intellectual property of NQB AI Inc. You may not copy, modify, distribute, or create derivative works without our written permission.

6. Service Availability

We strive to maintain 99.9% uptime for our AI phone agent services. However, we do not guarantee uninterrupted service and are not liable for service interruptions caused by factors beyond our reasonable control, including network outages, force majeure, or scheduled maintenance.

7. Limitation of Liability

To the maximum extent permitted by law, NQB AI Inc. shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service, including lost revenue, missed calls during service disruptions, or decisions made based on information provided by the AI agent.

8. Termination

Either party may terminate the service at any time. Upon termination, we will retain your data for a period of 30 days, after which it will be permanently deleted unless otherwise required by law.

9. Governing Law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Quebec.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the service constitutes acceptance of the modified Terms.
